The following terms of service (these "Terms of Service" / “Terms” / “Terms and Conditions”), govern your access to and use of the AlignTogether.live website, including any content, functionality and services offered on or through www.aligntogether.live (the "Site" or the “Platform”) by AlignTogether Solutions Pvt. Ltd. (“Company”), a company incorporated under the provisions of the Companies Act, 2013 with its registered office at G-2/320-A, Gulmohar Colony, Bhopal, Madhya Pradesh – 462039, India. AlignTogether Solutions Pvt. Ltd. is referred herein as "AlignTogether" “ AlignTogether.live” "we" or "us" and “you” or “user” means you as an user of the Site.

Please read the Terms of Service carefully before you start to use the Site. By using the Site, opening an account or by clicking to accept or agree to the Terms of Service when this option is made available to you, you accept and agree, on behalf of yourself or on behalf of your employer or any other entity (if applicable), to be bound and abide by these Terms of Service and AlignTogether Payment Terms, found here (“ Payment Terms ”) , which is incorporated herein by reference. You further acknowledge, you have read and understood our Privacy Policy.

If you do not want to agree to (or cannot comply with) these Terms of Service or the Privacy Policy , you must not access or use the Site. For more detailed policies surrounding the activity and usage on the Site, please access the designated articles herein.

This Site is offered and available to users who are at least 18 years of age and of legal age to form a binding contract. If you are under 18 and at least 13 years of age, you are only permitted to use the Site through an account owned by a parent or legal guardian with their appropriate permission. If you are under 13 you are not permitted to use the Site or the AlignTogether services. By using the Site, you represent and warrant that you meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Site.

The original language of these Terms of Service, as well as all other texts throughout the Site, is English. AlignTogether makes this translation available for convenience only. In case of conflicts between the original English version and any translation, the English version shall prevail. This Terms of Service does not require any physical, electronic or digital signature.

Services

The Site brings together user engagement, content delivery and administration tools in one place and is focused on helping experts go online to support a live interactive approach and online knowledge commerce solutions through video conferencing and related services (together or individually referred to as “Service(s)”) operated by the Company. The Company will provide the Services, and standard updates to the Services that are made generally available by the Company during the term. The Company may, in its sole discretion, discontinue the Service(s) or modify the features of the Service(s) from time to time without prior notice. Subject to all the terms and conditions of the Agreement, the Company grants non-exclusive, non-transferable, non-sublicensable right and license to access and use the Site and the Service(s) solely for your business purposes or for educational purposes, but only in accordance with the Agreement and these Terms of Services (including without limitation any applicable service-specific terms), the documentation, and all applicable scope of Use descriptions.

Links to other websites

Our Service may contain links to third-party websites or services that are not owned or controlled by AlignTogether. AlignTogether has no control over and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that the AlignTogether shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services. We strongly advise You to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

System Requirements

Use of the Services requires one or more compatible devices, Internet access (fees may apply), and certain software (fees may apply), and may require obtaining updates or upgrades from time to time. Because use of the Services involves hardware, software, and internet access, your ability to access and use the Services may be affected by the performance of these factors. High speed Internet access is recommended. You acknowledge and agree that such system requirements, which may be changed from time to time, are your responsibility.

Key Terms

User means the person accessing the AlignTogether.live .

Buyers are users who purchase services on AlignTogether.live.

Sellers or Freelancers are users who offer and perform Services on AlignTogether.live.

Become a Seller Sellers need to provide certain details on the platform to get a Seller status and qualify to create their services.

Creating a Service Sellers create their services which are then offered to Buyers.

Bookings or Orders are the formal agreements between a Buyer and Seller after a purchase was made from the Seller’s Service Page.

Create a Service -> Number of participants: AlignTogether provides two options to Sellers while creating a Service for controlling the number of bookings per time slot. Sellers can allow for only a single (one) booking per time slot or multiple (more than one) bookings per time slot.

Create a Service -> Number of sessions: AlignTogether provides two options to Sellers while creating a Service for controlling the number of sessions submitted per booking.

Service Types are the four (4) different kinds of formats of services which any Seller can create through the use of following two variables -

number of participants (1 or greater than 1) and
number of sessions (1 or greater than 1).

Type 1: Single Session 1-on-1 -

Number of Session = 1 ; Number of Participants = 1
A recurring service offering to connect a single buyer and the seller over a single session.

Type 2: Single Session Group -

Number of Session = 1 ; Number of Participants = Greater than 1
A recurring service offering to connect a group of buyers and the seller over a single session.

Type 3: Multiple Sessions 1-on-1 -

Number of Session = Greater than 1 ; Number of Participants = 1
A recurring service offering to connect a single buyer and the seller over a series of sessions with the same duration.

Type 4: Multiple Sessions Group -

Number of Session = Greater than 1 ; Number of Participants = Greater than 1
A one time service offering to connect a group of buyers and the seller in a series of pre scheduled sessions of varying duration.

Order Management -> Order Page is where Sellers can see details of orders received from buyers. Details include order requests, upcoming session(s) and order history.

Order Management -> My Bookings Page is where Buyers can see details of those services which they have purchased. Details include recent booking, upcoming session(s) and booking history.

Service Detail or Booking Page is where the Seller can describe their Service and the Service’s terms, and the Buyer can book the Service and create an order.

Overview (Main terms, in a nutshell)

Only registered users may buy and sell on AlignTogether. Registration is free. In registering for an account, you agree to provide us with accurate, complete and updated information and must not create an account for fraudulent or misleading purposes. You are solely responsible for any activity on your account and for maintaining the confidentiality and security of your password. We are not liable for any acts or omissions by you in connection with your account.
Buyers pay AlignTogether in advance to create an order (see Payment Terms ) .
Orders are purchased through the “Book Service” button found on a Seller’s Booking page.
For fees and payments please read the Payment Terms .
Sellers must fulfill their orders, and may not cancel orders on a regular basis or without cause. Canceling orders will affect Sellers’ reputation and status.
Seller's gain account statuses (Levels) based on their performance and reputation. Advanced levels provide their owners with benefits, including offering services for higher prices (see Seller Levels).
Users may not offer or accept payments using any method other than placing an order through AlignTogether.live.
When purchasing a Service, Buyers are granted all rights for the delivered work, unless otherwise specified by the Seller on their Service page.
AlignTogether retains the right to use all published delivered works for AlignTogether marketing and promotion purposes

SELLERS

Basics

Sellers create Services on AlignTogether to allow Buyers to purchase their services.
Each Service you sell and successfully complete, accredits your account with a revenue equal to 80% of the purchase amount.
AlignTogether accredits Sellers once an order or booking is completed. See our "Orders / Bookings" section below for a definition of a completed order.

Sellers may not promote their Services or any AlignTogether content via the Google Ads platform.
The Seller's rating is calculated based on the order/booking reviews posted by Buyers. High ratings allow Sellers to obtain advanced Seller levels (see Seller Levels). In certain cases, exceedingly low ratings may lead to the suspension of the Seller’s account.
For security concerns, AlignTogether may temporarily disable a Seller’s ability to withdraw revenue to prevent fraudulent or illicit activity. This may come as a result of security issues, improper behavior reported by other users, or associating multiple AlignTogether accounts to a single withdrawal provider.

Seller Services

Sellers are allowed to post a select amount of active Services based on their Level status (see Seller Levels).
Services created on AlignTogether are User Generated Content.
Services and/or users may be removed by AlignTogether from the Site for violations of these Terms of Service, which may include (but are not limited to) the following violations and/or materials:

Illegal or Fraudulent services
Copyright Infringement, Trademark Infringement, and violation of a third party's terms of service
Adult oriented services, Pornographic, Inappropriate/Obscene
Intentional copies of Services
Spam, nonsense, or violent or deceptive Services
Services misleading to Buyers or others
Reselling of regulated goods
Offering to prepare academic works on behalf of Buyers
Exceedingly low quality Services
Promoting AlignTogether and/or AlignTogether Services through activities that are prohibited by any laws, regulations, and/or third parties' terms of service, as well as through any marketing activity that negatively affects our relationships with our users or partners.

Services that are removed for violations mentioned above, may result in the suspension of the Seller’s account.
Services that are removed for violations are not eligible to be restored or edited.
Services may be removed from our Search feature due to poor performance and/or user misconduct.
Services may include pre-approved website URLs contained within the Service description and requirements box. Services containing websites promoting content, which violates AlignTogether’s Terms of Service and/or our Community Standards, will be removed.
Services are required to have an appropriate Service video / images related to the service offered. Sellers must deliver the same quality of service as shown on their Service videos / images. Recurring deliveries that don’t match the quality shown on the Service videos / images may lead to the Seller’s account losing Seller status or becoming permanently disabled.
Statements on the Service Page that undermine or circumvent these Terms of Service are prohibited.

BUYERS

Basics

You may not offer direct payments to Sellers using payment systems outside of the AlignTogether platform
AlignTogether retains the right to use all publicly published delivered works for AlignTogether marketing and promotional purposes.

Purchasing or booking a Service

To buy or book any service, the user has to go to “Service Booking Page” and choose the respective time slots or package (Multiple Session, Group Service) and then make the required payment to avail the live interactive service.

The buyer must provide AlignTogether.live with the correct information pertaining to the cardholder's name, the card number, the card expiry date and the security code on the back of the card (if any) in order to make payment to book the service. The user shall be responsible for the correctness of the information provided and shall not be indemnified if the information is wrongly entered whether intentional or unintentional.

You may not offer Sellers to pay, or make payment using any method other than through the AlignTogether.live site. In case you have been asked to use an alternative payment method, please report it immediately to Customer Support here.

Reviews

Feedback reviews provided by Buyers while completing an Order are an essential part of AlignTogether's rating system. Reviews demonstrate the Buyer's overall experience with the Sellers and their service. Buyers are encouraged to communicate to the Seller any concerns experienced during their active order in regards to the service provided by the Seller.
Leaving a Buyer's feedback is a basic prerogative of a Buyer. Feedback reviews will not be removed unless there are clear violations of our Terms of Service.
To prevent any misuse of our Feedback system, all feedback reviews must come from legitimate sales executed exclusively through the AlignTogether platform from users within our Community. Purchases arranged, determined to artificially enhance Seller ratings, or to abuse the AlignTogether platform with purchases from additional accounts, will result in a permanent suspension of all related accounts.
Feedback comments given by Buyers are publicly displayed on a Seller’s Service page.
Withholding the delivery of services, files, or information required to complete the Service’s service with the intent to gain favorable reviews or additional services is prohibited.
Responding and posting a review: Once a Service is delivered, the Buyer has 72 hours to respond. If no response is provided within the response period, the in-progress Review rating is considered submitted.
Sellers may not solicit the removal of feedback reviews from their Buyers through mutual cancellations.

Accounts

Use of Services on the Platform is available only to persons who can form legally binding contracts. When you create an account with us, you guarantee that you are above the age of 18 years, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Platform. In case the Service needs to be used by a person under the age of 18 years, then the account must be created by the parents or legal guardian who has agreed to these Terms of Services. In the event a person below the age of 18 years utilizes the Service, it is assumed that he/she has obtained the consent of the parents or legal guardian and such use is made available by the parents or legal guardian. The Company will not be responsible for any consequence that arises as a result of misuse of any kind that may occur by virtue of any person registering for the Service.

You are responsible for maintaining the confidentiality of your account and/or password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar or obscene. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion.

Communications

When You use the Services or send emails or other data, information or communication to the Platform You agree and understand that you are communicating with the Company through electronic modes and other telecommunication modes and by using our Service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send via any and all electronic, digital and other telecommunication modes. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or by emailing at hello@aligntogether.live.

The Company may, based on any form of access to the Site or Services or registrations through any source whatsoever, contact the User through WhatsApp, SMS, email, and call, to give information about its products as well as notifications on various important updates and/or to seek permission for demonstration of its products. The User expressly grants such permission to contact him/her through telephone, WhatsApp, SMS, e-mail and holds the Company indemnified against any liabilities including financial penalties, damages, expenses in case the User’s mobile number is registered with Do not Call (DNC) or Do not Disturb (DND). By registering yourself, you agree to make your contact details available to Our employees, associates and partners so that you may be contacted for education information and promotions through telephone, WhatsApp, SMS, email, etc.

Shipping Policy

AlignTogether.live platform offers live interactive services which may or may not require the use of digital or physical goods by the Sellers. AlignTogether does not handle delivery of any digital or physical goods. Whoever requires the delivery of goods for any kind of service, shall be responsible for their delivery. AlignTogether shall not be responsible or liable for any damages or other problems resulting from any kind of shipping done by any Seller/Buyer.

Due to the fact that we are a digital service provider platform, we do not encourage the sellers to take orders which include delivery of tangible goods nor do we suggest the buyer book the services which include the delivery of goods. By this, we don’t fall under any shipping policy of digital or physical goods in the form of Import and Export.

Analytics

We may use third-party service providers to monitor and analyze the use of our Services.

Intellectual Property

The Platform and its original content (excluding Content provided by users), features and functionality, structure, expression, “look and feel”, all graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork and computer code (“Company Data”) are and will remain the exclusive property of the Company and its licensors. The Platform may be protected by copyright, trademark, and other applicable laws in the jurisdiction applicable to the operations of the Company . Our trademarks may not be used in connection with any product or service without the prior written consent of the Company.

Except as expressly provided in these Terms of Services, no part of the Platform and no Company Data may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including “mirroring”) to any other computer, server, website or other medium for publication or distribution or for any commercial use, without the Company’s express prior written consent. Company Data on the Platform is solely for your personal, limited and non-exclusive use. Use of the Company Data on any other web site or networked computer environment or use of the Company Data for any purpose other than personal, non-commercial use is a violation of the copyrights, trademarks, and other proprietary rights, and is prohibited.

Copyright Policy

We respect the intellectual property rights of others and expect our users to do the same. The Company may terminate in appropriate circumstances the accounts of users who infringe or are believed to be infringing the rights of copyright holders.

Disclaimer of Warranty

The platform and services and the company data are provided by the company on an “as is” and “as available” basis. Company makes no representations or warranties of any kind, express or implied, as to the operation of their platform and the services, or the information, content or materials included therein. You expressly agree that your use of the platform, their content, and any services or items obtained from us is at your sole risk.

Neither company nor any person associated with the company makes any warranty or representation with respect to the completeness, security, reliability, quality, accuracy, or availability of the services or its content. Without limiting the foregoing, neither company nor anyone associated with company represents or warrants that the platform, their content, or any services or items obtained through the services will be accurate, reliable, error-free, or uninterrupted, that defects will be corrected, that the services or the platform that makes it available are free of viruses or other harmful components or that the platform or any services or items obtained through the platform will otherwise meet your needs or expectations. Company hereby disclaims all warranties of any kind, whether express or implied, statutory, or otherwise, including but not limited to any warranties of merchantability, non-infringement, and fitness for particular purpose. The company will not be liable for any losses, damages or claims by you or any third-party in this regard. The foregoing does not affect any warranties which cannot be excluded or limited under applicable law.

Indemnity and Limitation of Liability

Except as prohibited by law, you will hold us and our licensor, officers, directors, employees, other licensee and agents harmless for any loss, damage, or claim, however it arises (including attorneys’ fees and all related costs and expenses of litigation and arbitration, or at trial or on appeal, if any, whether or not litigation or arbitration is instituted), whether in an action of contract, negligence, or other tortious action, or arising out of or in connection with this agreement, including without limitation any claim for personal injury or property damage, arising from this agreement and any violation by you of any central, state, or local laws, statutes, rules, or regulations or terms of service, even if company has been previously advised of the possibility of such losses or damage or claims. Except as prohibited by law, if there is liability found on the part of the company, it will be limited to the amount paid by you for the products and/or services on the platform. Under no circumstance, including, but not limited to, negligence, shall the company be liable for any indirect, incidental, special, exemplary, damages for lost profits, business interruption and loss of programs or information arising out of the use of or inability to use the platform or consequential damages that result from the use of, or the inability to use, including but not limited to the information, content, materials on the platform, or any part thereof. While the company shall take reasonable precautions against security breaches, the platform or internet transmission is not completely secure, and as such, the company shall not be liable for any indirect, special, exemplary, or consequential damages that may result from unauthorized access, hacking, data loss, or other breaches that may occur.

Termination

We may terminate or suspend your account and bar access to the Platform or any of the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms of Services or any other Agreement. If you wish to terminate your account, you may simply discontinue using Service. All provisions of these Terms of Services which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability. Notwithstanding the foregoing, if you breach these Terms of Services or Privacy Policy or other rules and policies, the Company reserves the right to recover any amounts due and owing by you or to take strict legal action including but not limited to a referral to the appropriate police or other authorities for initiating criminal or other proceedings against you.

Governing Law

These Terms of Services shall be governed and construed in accordance with the laws of India, which governing law applies to agreement without regard to its conflict of law provisions, and any disputes relating to these Terms of Services and other Agreements will be subject to the exclusive jurisdiction of the courts of Bhopal, Madhya Pradesh, India.

Force Majeure

The Company is not liable for any delay in the performance or non-performance of any of its obligations hereunder and shall not be liable for any loss or damages caused thereby where the same is occasioned by any cause whatsoever that is beyond our control including but not limited to an act of God, war, civil disturbance, governmental or parliamentary restrictions, prohibitions or enactments of any kind, or accident or non-availability/ delay in transport, any endemic, pandemic, epidemic or outbreak of any disease including Covid-19.

Changes To Service

We reserve the right to withdraw or amend our Services, and any service or material we provide via the Platform, in our sole discretion without notice. We will not be liable if for any reason all or any part of Service is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Platform or the Services, or the entire Platform, to users, including registered users.

Amendments To Terms

We may amend these Terms of Services at any time by posting the amended terms on the Platform. It is your responsibility to review these Terms of Services periodically. Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.

By continuing to access or use our Platform and the Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Platform and the Service.

Waiver And Severability

No waiver by Company of any term or condition set forth in Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Company to assert any right or provision under Terms of Services shall not constitute a waiver of such right or provision. If any provision of Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Terms of Services will continue in full force and effect.

Assignment

The Company may transfer, sub-contract or otherwise deal with its rights and/or obligations under these Terms of Services without notifying you or obtaining your consent. You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these Terms of Services.

User Conduct and Protection

AlignTogether.live enables people around the world to create, share, sell and purchase nearly any service they need at an unbeatable value. Services offered on AlignTogether reflect the diversity of an expanding freelancer economy.

AlignTogether maintains a friendly, community spirited, and professional environment. Users should keep to that spirit while participating in any activity or extensions of AlignTogether. This section relates to the expected conduct users should adhere to while interacting with each other on AlignTogether. To report a violation of our Terms of Service, User Misconduct, or inquiries regarding your account, please contact our Customer Support team here.

Basics

To protect our users' privacy, user identities are kept anonymous. Requesting or providing Email addresses, Skype/IM usernames, telephone numbers or any other personal contact details to communicate outside of AlignTogether in order to circumvent or abuse the AlignTogether.live messaging system or AlignTogether.live platform is not permitted.
Any necessary exchange of personal information required to continue a service may be exchanged during the live interactive session.
AlignTogether does not provide any guarantee of the level of service offered to Buyers.
AlignTogether does not provide protection for users who interact outside of the AlignTogether platform.
All information must be performed exclusively on AlignTogether's platform.
Rude, abusive, improper language, or violent messages will not be tolerated and may result in an account warning or the suspension/removal of your account.
AlignTogether.live is open to everyone. You undertake not to discriminate against any other user based on gender, race, age, religious affiliation, sexual orientation or otherwise and you acknowledge that such discrimination may result in the suspension/removal of your account.
Users may not submit proposals or solicit parties introduced through AlignTogether to contract, engage with, or pay outside of AlignTogether.

Orders

Users with the intention to defame competing Sellers by ordering from competing services will have their reviews removed or further account status related actions determined by review by our Trust & Safety team.
Users are to refrain from spamming or soliciting previous Buyers or Sellers to pursue removing/modifying reviews or canceling orders that do not align on Order Cancellation or Feedback policies.

Services from Sellers

Users may report Services to Customer Support that may be in violation of AlignTogether’s Terms of Service based on the reported Services’ replicated similarity to pre-existing services (copycat Services).
Sellers warrant that any content included in their Services shall be original work conceived by the Sellers and shall not infringe any third-party rights, including, without limitation, copyrights, trademarks, or service marks. In the event that certain music or stock-footage media are incorporated within the Services, Sellers represent and warrant that they hold a valid license to use such music and/or footage and to include them in the Services.
AlignTogether will respond to clear and complete notices of alleged copyright or trademark infringement.

Reporting Violations

If you come across any content that may violate our Terms of Service, you should report it to us through the appropriate channels created to handle those issues as outlined in our Terms of Service. All cases are reviewed by our Trust & Safety team. To protect individual privacy, the results of the investigation are not shared. You can review our Privacy Policy for more information.

Violations

Users may receive a warning to their account for violations of our Terms of Service and/or any user misconduct reported to our Trust and Safety team. Warnings do not limit account activity, but can lead to your account losing Seller statuses or becoming permanently disabled based on the severity of the violation.

Non-Permitted Usage

Adult Services & Pornography - AlignTogether does not allow any use of adult oriented or pornographic materials and services.

Inappropriate Behavior & Language -Communication on AlignTogether should be friendly, constructive, and professional. AlignTogether condemns bullying, harassment, and hate speech towards others. We allow users a medium for which messages are exchanged between individuals or a system to rate orders.

Phishing and Spam -Members’ security is a top priority. Any attempts to publish or send malicious content with the intent to compromise another member’s account or computer environment is strictly prohibited. Please respect our members privacy by not contacting them with offers, questions, suggestions or anything which is not directly related to their Services or orders.

Privacy & Identity - You may not publish or post other people's private and confidential information. Sellers further confirm that whatever information they receive from the Buyer, which is not public domain, shall not be used for any purpose whatsoever other than for the delivery of the work to the Buyer. Any users who engage and communicate off of AlignTogether will not be protected by our Terms of Service.

Authentic AlignTogether Profile - You may not create a false identity on AlignTogether, misrepresent your identity, create a AlignTogether profile for anyone other than yourself (a real person), or use or attempt to use another user’s account or information; Your profile information, including your description, skills, location, etc., while may be kept anonymous, must be accurate and complete and may not be misleading, illegal, offensive or otherwise harmful. AlignTogether reserves the right to require users to go through a verification process in order to use the Site (whether by using ID, phone, camera, etc.).

Intellectual Property Claims -AlignTogether will respond to clear and complete notices of alleged copyright or trademark infringement, and/or violation of third party’s terms of service.

Fraud / Unlawful Use - You may not use AlignTogether for any unlawful purposes or to conduct illegal activities.

Abuse and Spam

Multiple Accounts - To prevent fraud and abuse, users are limited to one active AlignTogether account. Any additional account determined to be created to circumvent guidelines, promote competitive advantages, or mislead the AlignTogether community will be disabled. Mass account creation may result in disabling of all related accounts. Note: any violation(s) of AlignTogether’s Terms of Service is a cause for permanent suspension of all accounts.

Targeted Abuse - We do not tolerate users who engage in targeted abuse or harassment towards other users on AlignTogether. This includes creating new multiple accounts to harass members through our message or ordering system.

Selling Accounts - You may not buy or sell AlignTogether accounts.

Proprietary Restrictions

The Site, including its general layout, look and feel, design, information, content and other materials available thereon, is exclusively owned by AlignTogether and protected by copyright, trademark, and other intellectual property laws. Users have no right, and specifically agree not to do the following with respect to the Site or any part, component or extension of the Site: (i) copy, transfer, adapt, modify, distribute, transmit, display, create derivative works, publish or reproduce it, in any manner; (ii) reverse assemble, decompile, reverse engineer or otherwise attempt to derive its source code, underlying ideas, algorithms, structure or organization; (iii) remove any copyright notice, identification or any other proprietary notices; (iv) use automation software (bots), hacks, modifications (mods) or any other unauthorized third-party software designed to modify the Site; (v) attempt to gain unauthorized access to, interfere with, damage or disrupt the Site or the computer systems or networks connected to the Site; (vi) circumvent, remove, alter, deactivate, degrade or thwart any technological measure or content protections of the Site; (vii) use any robot, spider, crawlers or other automatic device, process, software or queries that intercepts, “mines,” scrapes or otherwise accesses the Site to monitor, extract, copy or collect information or data from or through the Site, or engage in any manual process to do the same, (viii) introduce any viruses, trojan horses, worms, logic bombs or other materials that are malicious or technologically harmful into our systems, (ix) use the Site in any manner that could damage, disable, overburden or impair the Site, or interfere with any other users’ enjoyment of the Site or (x) access or use the Site in any way not expressly permitted by these Terms of Service. Users also agree not to permit or authorize anyone else to do any of the foregoing. Except for the limited right to use the Site according to these Terms of Service, AlignTogether owns all right, title and interest in and to the Site (including any and all intellectual property rights therein) and you agree not to take any action(s) inconsistent with such ownership interests. We reserve all rights in connection with the Site and its content (other than User Generated Content) including, without limitation, the exclusive right to create derivative works.

Feedback Rights

To the extent that you provide AlignTogether with any comments, suggestions or other feedback regarding the AlignTogether platform or the Site as a whole, as well as other AlignTogether products or services (collective, the “Feedback”), you will be deemed to have granted AlignTogether an exclusive, royalty-free, fully paid up, perpetual, irrevocable, worldwide ownership rights in the Feedback. AlignTogether is under no obligation to implement any Feedback it may receive from users.

Confidentiality

Sellers should recognize that there might be a need for Buyers to disclose certain confidential information to be used by Sellers for the purpose of delivering the ordered work, and to protect such confidential information from unauthorized use and disclosure. Therefore, Sellers agree to treat any information received from Buyers as highly sensitive, top secret and classified material. Without derogating from the generality of the above, Sellers specifically agree to (i) maintain all such information in strict confidence; (ii) not disclose the information to any third parties; (iii) not use the information for any purpose except for delivering the ordered work; and (vi) not to copy or reproduce any of the information without the Buyer’s permission.

General Terms

AlignTogether reserves the right to put any account on hold or permanently disable accounts due to breach of these Terms of Service and/or our Community Standards or due to any illegal or inappropriate use of the Site or services.
Violation of AlignTogether's Terms of Service and/or our Community Standards may get your account disabled permanently.
Users with disabled accounts will not be able to sell or buy on AlignTogether.
Users who have violated our Terms of Service and/or our Community Standards and had their account disabled may contact our Customer Support team for more information surrounding the violation and status of the account.
Users must be able to verify their account ownership through Customer Support by providing materials that prove ownership of that account.
Disputes should be handled by contacting AlignTogether Customer Support.
AlignTogether may make changes to its Terms of Service from time to time. When these changes are made, AlignTogether will make a new copy of the terms of service available on this page.
You understand and agree that if you use AlignTogether after the date on which the Terms of Service have changed, AlignTogether will treat your use as acceptance of the updated Terms of Service.

User Generated Content

User Generated Content ("UGC") refers to the content added by users as opposed to content created by the Site. All content uploaded to AlignTogether by our users (Buyers and Sellers) is User Generated Content. AlignTogether.live does not check user uploaded/created content for appropriateness, violations of copyright, trademarks, other rights or violations and the user uploading/creating such content shall be solely responsible for it and the consequences of using, disclosing, storing, or transmitting it. The Company is under no obligation to examine or verify any Content posted on the Platform by You, and the Company assumes no responsibility or liability relating to any such Content on the Platform nor does the Company assume or shall assume responsibility or liability for breach of any of your obligation(s) under these Terms of Service. By uploading to, or creating content on, the AlignTogether platform, you represent and warrant that you own or have obtained all rights, licenses, consents, permissions, power and/or authority, necessary to use and/or upload such content and that such content or the use thereof in the Site does not and shall not (a) infringe or violate any intellectual property, proprietary or privacy, data protection or publicity rights of any third party (b) violate any applicable local, state, federal and international laws, regulations and conventions; and/or (c) violate any of your or third party’s policies and/or terms of service (d) contains video, photographs, or images of another person without his or her express written consent and permission or the permission or the consent of his/her guardian in the case of minor (e) tries to gain unauthorized access or exceeds the scope of authorized access to the Platform or to profiles, blogs, communities, account information, bulletins or other areas of the Platform or solicits passwords or personal identifying information for commercial or unlawful purposes from other Users. We invite everyone to report violations together with proof of ownership as appropriate. Reported violating content may be removed or disabled. We reserve the right to terminate the account of anyone found to be infringing any intellectual property right of any other person or violating any applicable laws or these Terms of Service.

Furthermore, AlignTogether is not responsible for the content, quality or the level of service provided by the Sellers. We provide no warranty with respect to the Services, their delivery and any communications between Buyers and Sellers. We encourage users to take advantage of our rating system, our community and common sense in choosing appropriate services.

By offering a service, the Seller undertakes that he/she has sufficient permissions, rights and/or licenses to provide, sell or resell the service that is offered on AlignTogether. Sellers advertising online their Service must comply with laws and terms of service of the advertising platform or relevant website used to advertise. Failing to do so may result in removal of the Service, as applicable, and may lead to the suspension of Seller's account.

Note that it is our policy in appropriate circumstances to disable and/or terminate the accounts of users who are repeat infringers. In addition, the Company can (and you hereby expressly authorize us to) disclose any information about you to law enforcement or other government officials, as we, in our sole discretion, believe necessary or appropriate in connection with the investigation and/or resolution of possible crimes, especially those that may involve personal injury.

Ownership

Ownership and limitations: When purchasing a Service on AlignTogether, unless clearly stated otherwise on the Seller's Service page/description, when the work is delivered, and subject to payment, the Buyer is granted all intellectual property rights, including but not limited to, copyright in the work delivered from the Seller, and the Seller waives any and all moral rights therein. Accordingly, the Seller expressly assigns to the Buyer the copyright in the delivered work. All transfer and assignment of intellectual property to the Buyer shall be subject to full payment for the Service, and the delivery may not be used if payment is canceled for any reason. For removal of doubt, in custom created work (such as art work, design work, report generation etc.), the delivered work and its copyright shall be the exclusive property of the Buyer and, upon delivery, the Seller agrees that it thereby, pursuant to these Terms of Service, assigns all right, title and interest in and to the delivered work to the Buyer.

Furthermore, users (both Buyers and Sellers) agree that unless they explicitly indicate otherwise, the content users voluntarily create/upload to AlignTogether, including Service texts, photos, videos, usernames, user photos, user videos and any other information, including the display of delivered work, may be used by AlignTogether for no consideration for marketing and/or other purposes.

Disclaimer of Warranties

YOUR USE OF THE SITE, ITS CONTENT AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE IS AT YOUR OWN RISK. THE SITE, ITS CONTENT AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER ALIGNTOGTHER NOR ANY PERSON ASSOCIATED WITH ALIGNTOGTHER MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY OR AVAILABILITY OF THE SITE.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Limitation on Liability

IN NO EVENT WILL ALIGNTOGETHER, ITS SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SITE OR SUCH OTHER WEBSITES OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE. THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
